Terms and Conditions of Use | SCODY

Welcome to SCODY. By accessing or using this website (the “Site”) or purchasing products from SCODY, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with these Terms, you should not use this Site or purchase from SCODY.

1. Definitions

(a) “Consumer” has the meaning given under the Australian Consumer Law (ACL).
(b) “Goods” means the products offered for sale on the Site.
(c) “Services” means any services provided by SCODY (including order fulfilment and customer support).
(d) “Promotional Code”, “Discount Code”, “Offer”, or “Promotion” means any special pricing, voucher, coupon, or campaign communicated via marketing channels.

2. General Terms

All orders for the sale of goods are accepted according to the terms and conditions below, and SCODY will supply the goods to you on these terms and conditions. By ordering an item from SCODY, you expressly agree to these terms and conditions. SCODY may amend these terms and conditions at any time, and any such amendment will be effective immediately. Your rights as a consumer under Australian Consumer Law are not affected by these terms and conditions.

3. Governing Law

You acknowledge that all website purchases are concluded in the State of Queensland, Australia, and as such are governed by the laws of Queensland. You and SCODY submit to the non-exclusive jurisdiction of the courts of Queensland.

4. Taxes and Duties

You are responsible for any taxes, duties or other liabilities imposed by any governmental agency on any product or service ordered by you from SCODY.

5. Product Guarantee and Quality

At SCODY we stand behind our products. Please refer to the Shipping, Returns, Refunds and Exchanges page for detailed information.

If the quality of our garment(s) does not meet your expectations, we will either repair the garment(s), replace the garment(s), or give you a full refund at our discretion. If we send you something that you didn't order, send you the wrong item, or sell you something that doesn't match its description, we will exchange it for the correct item or give you a full refund at our discretion.

6. Orders, Acceptance and Pricing

(a) All orders are subject to acceptance by SCODY.
(b) We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected misuse.
(c) If a product is listed at an incorrect price due to typographical or system error, SCODY reserves the right to cancel or adjust the order and issue a refund or notify you of the correct price.
(d) Any accepted order constitutes a binding agreement, subject always to your statutory rights under the ACL.

7. Consumer Guarantees and Non-Excludable Rights

Nothing in these Terms is intended to exclude, restrict or modify any rights under the Australian Consumer Law (ACL). You are entitled to a replacement, repair or refund where goods or services fail to meet consumer guarantees.

8. Retail Clothing Customers

(a) You are required to pay all amounts in full prior to dispatch unless you hold an account with SCODY. If you are an account customer, invoices are due for payment within 30 days from the date of invoice.
(b) If payment is due and is not paid within 60 days of the due date, SCODY may refuse to fulfil any other outstanding orders for you and reserves the right to charge interest on any outstanding amount at the rate of 1.5% per month.
(c) We accept the return of all unused retail garments that were not on sale at the time of purchase, provided they have the original tags in place and are returned within 90 days of purchase. We will exchange the garment or refund your money at our discretion.

9. Commemorative Event Clothing

(a) You are required to pay all amounts in full prior to dispatch.
(b) We will not accept the return of garments after the event date unless the garments are defective.

10. Custom Clothing Customers

(a) Quotes are valid for 30 days and may be revised if an order is not placed within that period.
(b) The fee for design services includes up to three hours of design work, and SCODY reserves the right to charge additional fees for designs that take longer.
(c) Any designs and artwork provided to you by SCODY are the property of SCODY and may not be used without written consent.
(d) You must approve and sign off on the garment designs and order quantities for each size before manufacturing commences. Orders cannot be changed after sign off, and you are liable for full payment on approval.
(e) When you approve your order, you also approve the colours. If precise matching of colours is required, we recommend requesting a printed fabric sample before final approval. A per-item charge applies for this service.
(f) For custom orders under $1000, full payment is required before manufacture. For orders over $1000, a 50% deposit is required before manufacture, and the remaining 50% before dispatch.
(g) SCODY reserves the right to sell or destroy garments that are rejected by you or have not been paid for within 60 days of manufacture.
(h) You warrant that you own or have permission from the registered owner to use any logos incorporated in the garment designs.
(i) The SCODY logo will be visible on the outside of the garment.
(j) SCODY reserves the right to use images of custom garments for promotional purposes.
(k) We do not accept returns on custom garments due to incorrect size being ordered. Sample garments and size charts are available to assist you in ordering correctly.

11. Private Shops

Private shops can be set up online at www.scody.com. There are a variety of shop styles to choose from.

The price for products in a private online shop is based on a quantity of 5 units. If you require a price based on more than 5 units then you will need to guarantee the higher quantity. In other words, the club, team or organisation will have to top up the order if there is a shortfall.

If the value of all orders in the shop is more than $2,500 and the total number of styles in the shop is less than 8, SCODY will make all garments ordered. If this is not the case, SCODY reserves the right to refund orders where a minimum quantity of 5 has not been met on the style.

Changes to styles and artwork are not permitted after the online shop has been opened.

In consultation with your SCODY account manager, you choose the garment styles and finalise the design for each garment type. The garments are then loaded onto our website for order. Your private shop can be password protected or not—it's up to you. An order close date is agreed upon, and your team places their orders before that date.

There are three payment options:
1. Paid in full online by each individual.
2. Partially subsidised by the organisation.
3. Fully subsidised by the organisation.

Delivery can be to individuals, a single location, or consolidated for multiple locations. Pickup is also available. If your order is bulk shipped, a Processing and Handling Fee (including freight) will be quoted once locations and weights are confirmed.

12. Promotional Codes and Discounts

SCODY reserves the right to refuse, cancel, or adjust any order where promotional or discount codes have been applied in error, misused, or otherwise used in a manner not intended by SCODY.

13. Marketing Communications and Promotional Errors

SCODY may from time to time promote offers through various marketing channels including, but not limited to, email, social media, our website, Google advertising, and other digital platforms. If any communication is issued in error or contains incorrect information (including pricing, discount amounts, dates, eligibility or availability), SCODY reserves the right to amend, withdraw or cancel the related promotion or offer at any time without prior notice. SCODY accepts no liability for any loss, cost or inconvenience arising from such amendment, withdrawal or cancellation, except where such liability cannot be excluded under the ACL.

14. Privacy and Data Use

Any personal information collected in connection with your use of the Site or participation in promotions will be handled in accordance with SCODY’s Privacy Policy. You agree that SCODY may use your information for order administration, marketing, and promotional purposes unless you opt out in accordance with the Privacy Policy.

15. Modification, Suspension or Cancellation of Promotions

SCODY may, at its discretion, suspend, cancel or modify any promotion, offer or communication at any time due to technical, operational or business reasons. Where reasonably practicable, SCODY will provide notice of significant changes.

16. Shipping and Delivery

Information about delivery times, methods and international shipping can be found on our Shipping, Returns, Refunds and Exchanges page. Delivery times are estimates only and may vary depending on location and carrier performance.

17. Returns and Exchanges

18. Limitation of Liability

To the maximum extent permitted by law, SCODY’s liability in connection with any communication, error, withdrawal or cancellation under these Terms is limited to the value of the relevant order or offer. SCODY will not be liable for any indirect, incidental or consequential loss. Nothing in these Terms limits your rights under the ACL.

19. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be severed and the remainder of the Terms will continue in full force and effect.

20. Changes to Terms

SCODY reserves the right to amend these Terms at any time. Updates will be posted on this page. Continued use of the Site after such changes constitutes your acceptance of the revised Terms.
